If you are served notice, do not hesitate, do the following and then call us at 617.720.0332 or contact our firm online to schedule an appointment.
- Note time, date, and method that you were served.
- Read the complaint and understand the charges. Make a copy of the complaint.
- Review the work-file, organize the material relating to the complaint, retain everything relating to the appraisal, and do not change anything.
- Do not talk to the plaintiff or licensing board representative. There is no Miranda warning with civil complaint and once a lawsuit is filed or a complaint served, you are in an adversarial situation. Anything you say can and likely will, be used against you.
- When you see the words negligence, fraud, grossly overstated value…do not take the complaint personally or unleash Mongo, your inner beast, put your energies into helping us build a defense.
